Terms of Use Agreement

1. Acceptance of Terms of Use Agreement.

At the instance you create a Yourtun account via any digital device, such as your mobile phones, tablets, personal computers, laptops, etc, you commit to being bound by our Terms of Use Agreement which refers to all the information herein available in this document, and all other agreement documents of the Yourtun platform which include our Privacy Policy and Creator Agreement, and that your use of our product and services is subject to your agreement to these conditions captured here and in our Privacy Policy and Creator Agreement. However, if you do not agree with any of the contents of this Terms of Use Agreement document, please, do not create an account on our platform or make use of our services or products.

This will serve as a formal and legally binding agreement for your use of the resources provided by our website. This agreement is effective immediately from the point of registering for a free account. Upon registering an account, you thereby agree that you have read, understood and accepted this agreement and all other accompanying policies, rules and regulations as indicated in this document.  Once accepted, this agreement shall serve as a legally binding agreement between you and us, and shall supersede any previous or existing agreement drawn up between you and us unless otherwise communicated formally.

We reserve the right to change or incorporate new conditions and terms into this agreement document intermittently as we deem fit without recourse to you. This may happen as a result of numerous reasons including without limitation, such as a new update in the product and service, a change in its functionality, a new law that is passed, an expansion of our business that may lead to some changes in our operations, to tackle any identified risks and dangers to us, our Website, Yourtun, to the users, or to any of our stakeholders and third-party vendors, to comply with the applicable laws and regulations and so on. We reserve the right at any given time to suspend, discontinue, change, or deactivate Yourtun without any liability or recourse to you. We could change the user interface (UI), graphics or other features on Yourtun intermittently as may suit our needs. We may change, discontinue, or restrict any section of the services on Yourtun as we see fit and do not guarantee uninterruptable access or availability of the content on Yourtun, or the constant availability and functionality of the website at all times. It is important you stay abreast of the current updates of the agreement document and always check from time to time to see if there are any new changes applied to the agreement as new version of the Terms of Use Agreement will be published on the website whenever a change or update is made. If after we have included some new changes to our agreement document and you maintain use of our services and product, then you have agreed to the changes in the updated Terms of Use Agreement and commit to abide by the new terms as indicated in the updated version of the Terms of Use Agreement.

Note that we reserve the right to change and modify these terms as we see fit at any time without notice.

If you are not okay with any part of these Terms of Use Agreement, please do not register an account on this platform. If you are an existing user and are not okay with any new changes that are made to updated versions of the Terms of Use Agreement, please discontinue the use of our product immediately and delete your account. If for any reason you have doubts about these Terms of Use Agreement, kindly stop or discontinue the registration process immediately. Note that once you complete the registration of an account on the Yourtun Website, you are unequivocally and irrevocably confirming that you have read, understood and unconditionally accepted the Terms of Use Agreement and any updates made and are thereby bound by the agreement therein.

2. Definitions of Terms

Our website is referred to as "Yourtun", and the website can be accessed via the URL https://yourtun.com;

The term "us", "we ", "our", "platform", used in this document refers to Dragup Global Enterprises (DGE), the owners of the website Yourtun;

The term "platform", "website", "web app", "site" used in this document refers to our website Yourtun;

"User": Any individual or entity who has created an account on Yourtun, be it an active content creator or a silent follower who just views, comments and like posts, sometimes referred to in this document as "you", "your", "them" or "they";

"Consumer": All users who utilise or just views content on the website;

"Content": All forms of material uploaded on the Yourtun website by any user, which could include video files, audio files, photos, text, images and any other form of data and material whatsoever meant for public and private consumption;

"Creator": Is a user who has registered a Yourtun account and has been verified and has access for uploading of content for free or paid viewing on the platform;

"Follower": A user who has followed another user or a creator, subscribed or paid to view the content of a creator. This is basically a user who has followed the account or profile of another user.

"Creator Earnings": The portion of revenue generated, or any other type of payment made by a user or follower to access a Creator’s content, receivable to a Creator in line with these Terms of Use Agreement document after deducting all applicable fees and commissions;

"Subscription": A user or follower's authorised automatic or manual renewal payments that serves as a binding agreement to obtain access for a specific period of time to the content that a Creator makes available to followers under their subscription packages. This excludes other individually priced PPV (Pay Per View) content; However, note that for now we do not offer subscription-based services on the Yourtun platform. The only form of payment services includes PPV, streaming and tips from other users.

"Pay Per View (PPV) Content": Are contents uploaded by Creators which are locked and only accessible for viewing by their followers and other users after the content have been unlocked by the follower or user by paying the fee indicated for unlocking the content.

3. Community Guidelines.

By using the Service, you agree that you will not;

  • abuse the use of this service by indulging in illegal or prohibited activities;

  • indulge in harmful or dangerous activities via this service;

  • damage or attack our image via this service;

  • disobey or disregard our community rules and regulations;

  • indulge in fraudulent attacks on other users via this service;

  • hijack or use other people’s images or posts without their consent;

  • carry out any form of harassment or intimidation of other users;

  • Infringe on other user’s rights via your posts and uploads with regards to their publicity and privacy rights, copyright, trademark or any other form of intellectual property or rights to specific contents;

  • promote violence, sexual harassment, incitement of hate through your utterances, discriminate, etc;

  • engage in spreading of pornographic and sexually explicit content. This is strictly prohibited;

  • encourage racism, war, division, incitement against any group of people, hatred, bigotry;

  • solicit passwords for any purpose, or personal identifying information for commercial or unlawful purposes from other users or disseminate another person's personal information without his or her permission;

  • maintain more than a single account, illegally access login credentials of other users, or utilize the same account as another user;

  • Creating another account without permission after being deleted or terminated from the website for violation of our terms and conditions;

We reserve the right to delete/terminate/remove/block any users account or content without the option of informing you in the event of a violation of our terms and conditions through your utterances, actions, uploads, activities and other similar activities via our website. Any action that violates the Terms of Use Agreement of any of the services we provide via our website will lead to our termination of your access to use the services of our website.

4. Prohibited Contents

Below are a list of content that are prohibited on the Yourtun platform, but are not limited to this;

Adult and Sexual Content

·        Pornography or sexually explicit content

·        Non-consensual sharing of intimate images ("revenge porn")

·        Sexual exploitation or solicitation of adults or minors

·        Deepfake pornography

Hate Speech and Discrimination - Content that promotes violence or hatred against people based on:

·        Race or ethnicity

·        Religion or belief system

·        National origin

·        Disability

·        Gender or gender identity

·        Sexual orientation

·        Caste, immigration status or veteran status

Violence and Threats

·        Direct threats of violence or harm

·        Incitement to violence, terrorism, or criminal activity

·        Graphic violence, including real or simulated gore

·        Promotion or glorification of violent crimes (e.g., mass shootings)

Harassment and Bullying

·        Targeted harassment or coordinated attacks

·        Doxxing (publishing private information)

·        Trolling with the intent to provoke or distress

·        Impersonation to harass or defraud

Terrorism and Criminal Organizations - Content that supports or promotes:

·        Terrorist groups

·        Organized crime

·        Extremist ideologies

·        Recruitment or radicalization

Illegal or Regulated Goods - Buying/selling of:

·        Drugs or drug paraphernalia

·        Firearms or ammunition

·        Counterfeit goods

·        Human trafficking or smuggling services

- Uploading other user's content for monetization

- Uploading content with watermark or logo of other social media sites for monetization

Spam and Scams

·        Phishing links or malware

·        Financial scams (e.g., investment fraud, fake giveaways)

·        Artificially inflating engagement (likes, followers, etc.)

·        Repetitive spam messages or comments

Users are advised to report accounts suspected of being guilty of engaging in posting the subject prohibited content once identified. We will carry out an independent investigation and review of the reported account and take decisive action once we confirm the report to be accurate. Users found guilty of engaging in posting the subject prohibited content on our website may have their verified status reversed and their account reduced to view access only or blocked/ suspended/ terminated/ deleted temporarily or permanently as we deem fit. Once your account is blocked or deleted permanently for posting of prohibited content on Yourtun, the funds left on your wallet after the application of the applicable charges, will be credited to your bank account. This will mark the end and severance of your relationship with Yourtun. Such users are henceforth prohibited from opening another account on the platform. If it is discovered that you opened another account on the platform after your initial account have been blocked/deleted, the new account will be blocked/deleted, and any fund in your wallet generated from activities on the platform from the new account will be forfeited.

5. Eligibility.

To be eligible to operate an account to post content and view content of other users on our platform a user must be a minimum of 15 years and above. We strongly recommended that a user should be a minimum of 13 years of age before they should be allowed to open any social media account. Age requirement compliance is confirmed at the point of identity verification. Where a user is found to be below this age requirement during the identity verification, the user account will be closed and deleted from the platform. To be eligible to post content on our platform, you must have fulfilled the following eligibility criteria given below, or else your account will be deleted from the platform at the point of identity verification. The requirements are as follows:

  • you must be a minimum of 15 years of age.

  • you must be willing to conform to our Terms of use Agreement.

  • you must not be under any restriction or inhibitions from the state government or any other legal body or entity within your country of jurisdiction and residence from making use of such services as ours.

  • you will conform to all laws at the local, state, national level of your resident country, and be guided by our rules and regulations.

  • you must have never been convicted of any form of crime against the local, state or federal government of your country at any point in time.

  • You agree to pay where required for a subscription, to gain access to creators streaming or PPV to access and view the content of Creators whose content you are interested in, in accordance with the Terms of Use Agreement.

If you fail to meet the stipulated requirements, your account will be deleted from the platform at the point of identity verification. The specific time of conducting the ID verification is at the discretion of the user. It could be done either immediately after signup by the user, or at the point of the user making their first withdrawal. However, note that users must verify their identity before they will be able to make their first withdrawal. We strongly recommend that users verify their identity immediately after signup to enjoy seamless use of the platform. You may also be asked to provide additional information as we deem necessary.

6. Your Account.

To have an account and utilise the services on Yourtun you must register and open an account on Yourtun by using any of the available signup methods provided via our website as it suits you. Yourtun reserves the right to reject, or delete an account application with or without reason as we deem fit. When registering an account, you must provide your basic biodata details such as your full name, correct date of birth, a valid email address, and a password. Your password must comply with the password requirements. A username will be assigned to you upon opening your account, and you can change the username to whatever suits you. You are solely responsible for the integrity and security of your login credentials which will be created and known only by you. You will be held responsible for any activity that occurs via your login details hence you should guide it carefully. If you feel your login details have been compromised, please initiate a password change immediately to safe guard the integrity of your account. If you encounter any challenges with changing your password, please contact us as soon as possible by using the contact form on the platform, or by sending us an e-mail to our designated email address which is given below, customercare@yourtun.com

7. What happens if my account becomes inactive?

An inactive account is an account in which the user has not logged into for 30 days. If a user’s account remains inactive for a continuous period of 30 days, by inactive, we mean the user has not been online on the platform for 30 days either to post or view content posted by other users, the account will be disabled and terminated from the portal to allow and accommodate onboarding of new users on the platform. This is so as to manage the disk space and storage capacity of the platform for accommodation of new and active users. In a case where there is sufficient capacity on the platform to manage both onboarding of new users and inactive accounts, then inactive accounts may be allowed to remain on the platform indefinitely without deletion until the users decide to login and access the account again, or until such a time as deemed fit by the platform to terminate and delete such accounts.

8. Verified Accounts and Posting Content

Users do not need to be verified to be able to post content on the Yourtun platform as users can immediately start posting once they sign up. However, only verified users are capable of withdrawing funds from their wallet on the platform. Non-verified users will be able to upload content, purchase or unlock content on the platform but will be unable to withdraw their funds until they are verified. Hence the reason we encourage users to verify their identity immediately after signup. To verify your identity on the Yourtun platform and enjoy seamless use of the platform, the following steps are required;

·       You must update your correct date of birth and full name on your account which will be confirmed by your valid government issued ID card details.

·       A clear facial photo displaying your full face must be on your profile picture/avatar during the period of verification. The absence of this will prevent verification of your account and further lead to decline of your ID verification on the platform.

·       Removal of full facial photo from your profile picture after you have been verified is acceptable. However, if you remove the full facial photo on your avatar prior to your account verification, this will lead to the decline of your verification request on the platform. Your full facial photo must always be available on the profile picture/avatar throughout the period of the verification process, and we may vary this specific requirement as we see fit as time goes by.

·       Provide a valid form of ID. The facial photo, name and date of birth on your account must match the image, name and date of birth on your valid ID;

·       You may be required to submit additional requirements if need be;

·       There is no time limit for the verification of an account. A verification request could either be successful or declined. This is strictly based on our discretion and capacity to accommodate new creators on our platform.

·       Where your account is successfully verified, you can continue using the platform freely to post various free and paid contents for all users on the platform to view and engage with. You may also post PPV content and set a price for the content you have locked for PPV access. You may now also withdraw funds from your wallet as you please.

·       Upload interesting and engaging Content to your Yourtun account for users and followers to view when they engage with your account;

9. Content.

Pornographic content is strictly prohibited on this website. You acknowledge and agree to this when you open an account on this website and begin uploading your content on this website. We are not responsible for the type of content you upload, and you will bear full liability and responsibility for any content uploaded via your account that is not in accordance with our Terms of Use Agreement. Your account may be blocked/ suspended/ terminated/ deleted if you are found to be uploading content that is prohibited on our website.

All contents uploaded on the platform are seen under the general feeds section of the website that have not been locked and hence can be seen by all users as it is for public consumption, viewing and entertainment, and it’s free for everyone to view at no cost for their own lawful and personal use and entertainment. Only content that have been locked by a creator under their PPV package or any other pay-based package, and any other form of single sales content, are not free and can only be accessed after the fee for accessing the content have been paid under the general feeds section or on the creator’s profile page. All content under the general feeds section (home page), and on any other section of the platform is free for all to view and enjoy as entertainment at no cost, except for those that have been locked as PPV content. Both locked (PPV) content, and unlocked (free) content can be viewed or access via the feeds page or creators profile page.

You are free to comment, like, engage and share other user’s content that appears under the home/general feeds section and any other page on the platform as it is free for entertainment and use by everyone, as this is a general practise on every social media platform, but you are prohibited from using a person’s original content for commercial or monetization purposes. If you discover your content has been used by another user for commercial or monetization purposes on our platform, you are required to report the particular content and provide proof that the content belongs to you. The reported content will be blocked/deleted from the account of the offender who uploaded the content once we have confirmed the accuracy of your claim/report by reviewing the evidence provided to prove the content belongs to you. Repeat occurrences of uploading other user’s content for commercial or monetization purposes without authorization from the owner of the content could lead to a total block/suspension/termination/deletion of the offending user’s account permanently. You can only monetize your own original work, be it a video, picture, comedy skit, etc.

The extent of action we can take for a reported case like this or any other case shall be to pull down the content once we have reviewed the proof presented to establish the ownership of the content by the user reporting the claim. Any other action intended to be taken by the user reporting the infringement shall be done outside our website and strictly between the two users without any involvement from us. We shall not be liable, or be a party to, or be involve with any further action taken as all users are legally responsible for all Content they upload via their account, irrespective of if a third-party manages your account or helps you to upload content on your account, as our relationship is with you and not with any third-party. Hence, you will be legally responsible for ensuring that all Content posted via your account and all use of your account complies with this Terms of Use Agreement. You unequivocally commit that every content you upload to Yourtun complies with the Terms of Use Agreement and all applicable laws, and you will be solely responsible for any infringement arising from the use of your account, and we have no liability for your actions. We reserve the right to remove any Content that violates our Terms of Use Agreement without recourse to you.

10 Routine Content Removal/Deletion on the Platform

Media, text files, and all other forms of content may not remain permanently on the platform. Files are deleted from the platform intermittently based on our discretion to manage the disk space size requirement and to maintain optimum performance of the platform. Files uploaded by a user could be removed or deleted any time between 24 to 48 hours and above after they have been uploaded, so as to manage the platform’s disk space and ensure optimum performance. Intermittent routine removal of content from the platform is basically based on disk space requirement and the need to effectively manage the platform. Besides the intermittent routine file removal/deletion that occurs on the platform for disk space management and optimum performance, users can also delete their uploaded files whenever they choose, except for PPV content. Note that the routine deletion on the platform Is a temporary measure put in place to manage optimum performance of the platform. Once the storage requirement of the platform has been attained, then all user files will remain on the platform indefinitely until the user decides to delete such files, or until such a time as deemed fit by the platform to terminate and delete such files.

11. Prices for Content

A price is the amount a Creator has fixed for a user to pay to be able to access their content. Prices for contents on the platform are fixed by Creators/users of the platform and owners of individual content. A user could decide to pay to any of the packages provided by a Creator or choose not to. The various types of price-based services may not always be available for the Creators to use, and hence Creators will only utilize the tools available on the platform at every moment. Creators are solely responsible for setting the prices for access to their content to any amount within a range of a minimum of N1,000 and a maximum of N50,000.

12. Charges

There is a charge applied on any fund earned by a user on the platform which is applied during a withdrawal from a user’s account. A charge of 30% is applied to all the funds available on a Creator’s wallet which have been earned through the Yourtun platform.

A Creator earns 70% of all income generated on the platform and it is credited to their local bank account upon initiation of a withdrawal within a minimum of 72 hours and above. The remaining 30% is charged as commission by the website, where 22% is retained by the platform, while 8% is for service charges for payment gateway service and VAT payment. The 30% is applied at the point of withdrawal from the user’s wallet on the platform.

13. How You Earn

A Creator can earn from the content they upload under their PPV content, by assigning a fee to access their live streaming, through tips from their followers or other users, through special requests payments from followers and users, and single item content for sale which could be under a PPV content. You can only earn when a user or follower pays for any of your content. You will not earn anything for any free content which is not locked under the home/general feeds or your profile section as all contents under these sections, or on our platform in general are free for viewing at no cost except for those that are locked as PPV content.

A Creator earns 70% of all the revenue generated from their earnings which include PPV, streaming, tips, and any other form of activity that generates revenue on the website into the user’s wallet. The remaining 30% is retained by the website for all forms of activities that maintains the website running and functioning at an optimally level.

Basically, there are 3 main methods of earning money on the Yourtun platform, and the methods include the Pay Per View (PPV) content, Streaming and Tips;

Pay Per View (PPV) Content: Are contents uploaded by Creators which are locked and only accessible for viewing by their followers and other users after the content have been unlocked by the follower or user by paying the fee indicated for unlocking the content. PPV content are available for single viewing for as long as the content remains available on the platform. Paying for a PPV access to a content does not grant ownership of the content to the follower or user who paid to unlock the content, but rather grants viewing access to the user or follower who has paid to unlock the PPV content for as long as the content remains on the platform. Once the specific content has been removed from the platform by the creator or the platform, you will not be able to view the content anymore.

Streaming: This is another method through which you can earn money of the platform. Creators can initiate a live video and fix a fee for access into the streaming session by other users. However, the streaming feature on the platform is not always available and hence users can only utilize the feature when it is made available on the platform. The streaming service we offer is not always open and may not be available at all times on the platform. Hence users may utilize the service only whenever it is up and available on the platform. Also note that the streaming services duration is limited. For every period the streaming service is made available on the platform, the specific duration for any streaming session initiated on the platform by a user will be given. It could be for 1 hour, 2 hours, or whatever length of time deemed fit by the platform. What this means is, if the streaming service has been made available on the platform, and the duration indicated by the platform is 2 hours for that period of availability which could be for 2 weeks, a month or whatever length of time the platform maintains it, once any user initiates a live streaming session, the session can only last for 2 hours before it ends. Once the session has lasted for 2 hours, that streaming session will be ended automatically irrespective of the time other users joined the live streaming. Our streaming service would be improved upon over time as the platform develops.

Tips: Tips are free cash gifts sent to creators by other users either to support their work, appreciate what they do, acknowledge their creativity and so on. You could get tips from friends and family and any user on the platform. The amount for tips is not fixed as it is a free gift hence the users get to determine the amount they intend to give. However, the minimum amount that can be sent as a tip is N1,000.

Note that on the Yourtun platform you do not make money from number of views, number of followers you have or length of view of your content by users. The platform does not pay you money for any of this form of activity. The only way you make money is when other user purchase your PPV content, pay to access your streaming session, or send you tips.

14. Payout / Withdrawals

Creator’s earnings will be paid out to the creator within a minimum of 72 working hours after they initiate a withdrawal request. Creators can only request for a payout if they have funds available in their Yourtun wallet and they have been verified on the platform. To be able to access the earnings available on your wallet, you will have to;

· Meet the minimum withdrawal threshold of N30,000 before you can make a withdrawal from your Yourtun account.

· During your first withdrawal request, you would need to provide a bank account payment detail that you would use during withdrawal where your earnings will be credited once you request a payout/withdrawal. There would be no need to provide a bank account detail during subsequent withdrawals as the bank account detail provided during your first withdrawal will be retained for future payments

· The name on your government issued valid ID must match the name on the bank account details you provide. Where there is a discrepancy in the names on your bank account and your government issued valid ID, your withdrawal request will be declined. Please ensure the name on the bank detail provided is the same as the name on your government issued valid ID card so as to prevent a decline of your withdrawal request;

· Payout could be completed between 24 hours and above. However, the standard expected payout timeline will be within a minimum 72 hours or more after your request is initiated;

· The minimum payout amount is N30,000. Once this threshold is met, you can withdraw at anytime and any specific amount from a minimum of N30,000 up to a maximum of N5,000,000 per withdrawal request based on the available balance in your Yourtun account.

15. Cash Deposit

While there is a cash deposit module on the platform, we currently do not allow cash deposit on the platform. We only allow for the withdrawal of earnings by creators on the platform. Any changes to this arrangement in the nearest future will be communicated accordingly as we continue to develop more features on the platform to satisfy our users. For this reason, the minimum and maximum amount for deposit on the platform has been placed at an infinitesimal figure to ensure deposits are not initiated, and to discourage any form of deposit on the platform pending any further changes or developments that may occur in the future.

16. Refund Policy

At Yourtun we operate a strict no-refund policy to ensure the safety of our Creators and to prevent fraudulent intensions. Once you have subscribed or paid for a Creators content and are probably not satisfied with the quality or focus of the content, you are free to choose to discontinue subscription to the content of that Creator and focus on their free content only or the content of other creators, or you may choose to unfollow the Creator as you see fit. You cannot request for a refund as we make no guarantees as regards the quality, the focus or entertainment value or depth of the contents uploaded by Creators. Note that this is a social media platform mainly for social engagement and entertainment activities. Hence earning of income is not the core focus of the platform, but a side activity that users are free to utilise to generate passive income. Hence, you can only stop paying to unlock the PPV content of users if you are not satisfied with the service or the content of users you patronize.

For cases of declined transactions for which a user is still debited, meaning the user was debited for the payment fee but the transaction was declined on the payment gateway, hence the user still has no access to the Creators PPV content since the system recognizes the transaction as a failed transaction. You may log a chargeback request with your bank for reversal by presenting evidence of the declined transaction.

For such successful chargeback cases, we will deduct an amount equal to the chargeback amount from the Creator Earnings portion where the creator has been credited for the failed transaction and our investigation prove that you were unable to access the content after successful payment for the content, and we will credit the funds back into the wallet of the user that requested the chargeback. However, if after investigations we confirm that the user successfully unlocked the content, the chargeback request will be declined with evidence of the user’s success in unlocking the content.

For cases where our investigation confirmed requested transactions initiated by the user were duly approved, meaning the user’s payment was approved on the payment gateway, the user was debited and the user successfully unlocked and accessed the Creators content, chargeback requests shall not be honoured. The request will be declined with evidence of the user’s success in unlocking the content as it is against our refund policy to refund funds for service that has already been rendered, which is, in this case, access to the Creators content, which has already been granted.

17. Available Payment Method

Please note that we do not allow card payment on our platform for now. The only method of payment available is by transfer. When a user intends to pay for any service or to access any content they are interested in, the user would have to fill out their details on the checkout page, then a temporarily generated account number is displayed as provided by the payment gateway to enable transfer payment. Our payment gateway provider is Paystack, which is a renowned and reliable payment system provider in Africa and other countries.

18. Updating Service and Termination of Account.

Our aim at Yourtun is to provide our users with a great experience while using our services, hence we may engage in the addition of new products, upgrades to previous features, inclusion of new features, removal of old and redundant features and the likes every now and then.

All users have the right to terminate their account whenever they like. We also reserve the right to terminate/delete/remove/close any users account and cancel any user activity on the platform on identifying any form of violation carried out by such a user on our website without any prior notice to the user. We will be mindful enough to cancel any active subscription on your account if the subscription option is made available on our platform in the future and you have a subscription running at the time. This is so as to protect you from any further billing if we are the one terminating, deleting, removing, or closing your account for any violation of our policy. However, if you are deleting your account from the platform yourself, you are responsible for deactivating or cancellation of any active running subscriptions on your account before you go ahead with the deletion so as to prevent the recurring subscription from passing further debits to your card from the payment gateway. You will be fully and solely responsible for any further subscription charges that may be passed to your card after you have deleted your account if you fail to cancel your active subscriptions before the deletion.

That being said, as indicated above, we currently do not offer subscription services or payment via debit/credit cards on our platform, Yourtun. The only method of payment remains via transfer through the payment gateway.

19. Decency in Communicating with Other Users.

While making use of our website we encourage users to conduct themselves in the most respectful manner during engagements with other users. Every user will be solely responsible for any utterance or statement made on the Yourtun website and we will not be held liable for whatever content, upload, action, words, or statement made by users.

We do not carry out any form of investigation or historical activities check on users of our website, hence do not guarantee the outcome of any interaction, meeting or engagement between users on the platform. This is solely at the discretion and choice of the users as they deem fit. However, we reserve the right to block/suspend/terminate/delete any account we feel has conducted itself in a way that is unacceptable and against our community guidelines and values of treating everyone with dignity and respect.

20. Applicable Laws and Jurisdiction

Note that these Terms of Use Agreement shall be governed by and interpreted in line with the laws of Nigeria and you irrevocably submit to the non-exclusive jurisdiction of the courts of Nigeria with regards to any dispute in relation to the Terms of Use Agreement.

21. Indemnity

You agree to indemnify Yourtun and its owners, DGE, its subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, and hold them free from any claim or demand, including reasonable attorney fees, made by any third-party due to or arising out of your breach of these Terms of Use Agreement, or your violation of any law or the rights of a third-party. You agree to indemnify Yourtun and its owners, DGE, its subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, and hold them free from any claim or demand, including reasonable attorney fees, you may seek arising between you and other users out of their breach of these Terms of Use Agreement or their violation of your rights. Such issues shall be settled strictly between the parties involved, being you and other users, or you and a third party, with we having no liability in such claims or disputes.
